Breaking Service agreement. Urgent....

hi
i work in an mnc(hcl), and im a fresher i want leave the company for some personal problems but i had first requested for a transfer but the hr was rude and didn't offer that so i have opted to quit without any note to the company , adding to it i have not submitted any certificates to the company..i have a bond for 18 months (1.25lac)
can you guide me on this...

Akram,

First thing is, if you quit with out any notice, HCL may not give you any experience certificate (as you haven't gave them any notice) and you can't show that experience else where. By the way, how much experience do you have in HCL? If the experience is 6+ months, I will suggest you to have a 2nd thought on it again before leaving it. Option is yours.

Any coming to the bond, what kind of bond is it? it is a work bond or credit or loan bond saying that you have taken that from company? If it is a work bond, then you can ignore it ( If I am not wrong, single sided work bonds are invalid under labour act). If is other kind of bond, then you should be careful. They can take legal action on you to get that money from you.

but i dont know to differentiate between these bonds...
the terms in the bond mainly say hcl has spent on my training so for that hcl wants me sign a bond for 1.25lac and in that it has also a pronote from my guarantor for the same amount.

Akram,

Bonds can be two way or 1 way. Generally we only see 1 way bonds which are invalid.

A 2 way bond is a one which is an agreement between both the parties. In this, employer should promise that he will not remove employee for a given tenure or until the assignment (in case of contract) is complete and employee should give agreement on that he will not leave company until the time period specified is completed or project/contract is void.

If the bond is given only by emplyee to the employer, then it is 1 way bond.
